The SleekAndHandy online store available on the website sleekandhandy.com is run by the ENSOLVER Mirosław Baszun, Al. Zwycięstwa 96/98, 81-451 Gdynia, Poland, VAT No PL9661124034, Regon 221905916.

§1.

Definitions

  1. Customerindividual, legal person or organization who places order.

  2. Seller – ENSOLVER Mirosław Baszun, sole proprietorship, with registered office at Al. Zwycięstwa 96/98, 81-451 Gdynia, Poland; EU VAT No PL9661124034, Regon (Busines Id) 221905916.

  3. Civil Code – the Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended) of Polish Law.

  4. Terms & Conditions - the following regulations for the provision of electronic services as part of the sleekandhandy.com online store.

  5. Online Store – website available at the internet address sleekandhandy.com in which the customer may place Orders.

  6. Goods – products presented in the Online Store.

  7. Sale Contract – a contract for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer using the Online Store.

  8. Consumer Rights Act – the act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827 as amended) of Polish law.

  9. Order – Customer's declaration of will, aimed directly at the conclusion of the Sale Contract, specifying in particular the type and quantity of the Goods.

§2

General provisions

  1. These Regulations define the rules for using the online store available at the internet address sleekandhandy.com (www.sleekandhandy.com).

  2. The online store, operating at the internet address sleekandhandy.com, is run by the Seller.

  3. These Regulations define in particular:
    a) the rules for registering and using the account as part of the Online Store;
    b) the rules and conditions for making electronic reservations of products available as part of the online store;
    c) the rules and conditions for submitting orders via electronic means as part of the online store;
    d) the rules for concluding Sale Contracts with the use of services provided as part of the Online Store.

§3.

Rules for using the online store

  1. The purchase of Goods does not require registration in the Store.

  2. The information provided on the Store's websites, including information about the presented products, and in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

  3. Placing an order is done using the form available on the store's website.

  4. Each registering and / or ordering Customer agrees to receive information related to the course of the transaction, notifications about changes in these Regulations to the e-mail address provided by him.

  5. In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.

§4.

Procedure for concluding a Sale Contract

  1. In order to carry out any Customer activity in the Store, proper operation of the Internet is required, the use of a web browser and an active account at the selected e-mail address.

  2. In order to conclude a Sale Contract via the Online Store, go to the website sleekandhandy.com, make a choice by taking subsequent steps based on the displayed messages and information on the store's website.

  3. The store allows you to purchase products and services 24 hours a day, 7 days a week.

  4. The selection of the ordered goods by the customer is made by adding them to the shopping basket.

  5. When placing an Order – until the button "Place an order" is pressed – the Customer can modify the entered data and select the Goods. To do this, follow the messages and information displayed on the website.

  6. To finalize the order, the customer is asked to provide all the necessary data needed to complete the order, i.e.:
    a) name and surname / company name,
    b) delivery address,
    c) e-mail,
    d) phone number,
    e) VAT No (tax id) - in case of a request for a VAT invoice.

  7. After the Customer has provided all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
    a) subject of the contract,
    b) the unit price and the total price of the ordered Goods or services, including delivery costs and additional costs (if any),
    c) selected payment method,
    d) selected delivery method.

  8. In order to send an Order, it is necessary to accept the Terms & Conditions, provide personal data marked as mandatory and press the "Place an order" button.

  9. Sending the Order by the Customer is a declaration of will to conclude a Sale Contract with the Seller, in accordance with the Terms & Conditions.

  10. After submitting and paying for the Order, the Customer receives an e-mail titled "Order Confirmation" containing the final confirmation of all essential elements of the Order.

  11. The contract is considered concluded at the moment the Customer receives the e-mail referred to above.

  12. The Sale Contract is concluded in Polish or English in accordance with Polish law, in accordance with the Regulations.

§5.

Delivery

  1. The cost of shipping is added to the sum of the ordered Goods and is borne by the customer, unless the conditions for free delivery are met, i.e. the value of the order must be higher than PLN 150 gross or the equivalent in the selected currency. The final price, binding for the Seller and the Customer, is the price of the product given in the offer at the time of placing the order by the Customer.

  2. The following delivery methods are available:
    a) InPost Paczkomaty (parcel lockers): delivery time 2-3 working days, only within Poland;
    b) Polish Post Registered Mail: delivery time 3-10 working days in Poland, 4-12 working days in the European Union, 8-25 working days to other countries;
    c) Pickup in person at the Seller's office after prior arrangement of the pickup date and time by phone or e-mail.

    The cost of delivery is calculated when placing the order, and its amount depends on the selected country of delivery, the size of the order and the type of delivery.

  3. Information on the total value of the order along with shipping costs is provided in the order summary on the product sales page and in the order confirmation.

  4. The Goods are delivered in the territory of Poland and to the European Union countries, also to the selected countries outside the European Union, to the address provided by the Customer when placing the Order.

  5. The shipment of the Order is carried out within 1 to 3 business days from the date of crediting the Seller's bank account if the Customer chooses the method of payment by bank transfer, electronic payment or payment card.

  6. Along with the shipment, the Customer will receive a printout of the confirmation and specification of the Order as well as a sales receipt. At the Customer's express request, a VAT invoice may be issued.

§6.

Information about prices and payment methods

  1. The prices of the Goods may be given in Polish zlotys (PLN), Euro (EUR) or in American dollars (USD) and include all components, including VAT obligatory in the Republic of Poland.

  2. The customer has the option to pay the price:

    a) by transfer to the bank account number indicated in the message confirming the order,

    b) fast online transfer via the PayNow payment system – for polish bank customers only,

    c) BLIK payment,

    d) payment by credit card: VISA, VISA Electron, MasterCard, MasterCard Electronic, Maestro. The entity providing online payment services in the field of card payments is Blue Media S.A.

§7.

Contract withdrawal

  1. The customer who is a consumer within the meaning of art. 22 of the Civil Code, you have the right - under the law - to withdraw from a distance contract or concluded outside the business premises, without giving any reason, by submitting an appropriate statement in writing or by e-mail and sending it within 14 days to the e-mail address sklep @ sleekandhandy. com or the address of the Seller's office provided in §1. of these Regulations. The seller voluntarily extends the return period to 21 days.

  2. In the event of withdrawal from a distance contract, the contract is considered void. What the parties testified is returned unchanged. The return should be made immediately, not later than within 21 days. The purchased goods should be returned to the following address:

  3. The Goods returned by the Customer should be packed in an appropriate manner, ensuring no damage to the contents of the shipment during transport.

  4. In the event of withdrawal from the Sale Contract, the Seller will return to the Customer all payments received from him, including the costs of delivering the goods (except for additional costs resulting from the method of delivery chosen by the Customer other than the cheapest method of delivery offered by the Store), immediately, no later than 14 days from the day on which the goods were returned. The seller shall refund the payment using the same method of payment as used by the consumer, unless the consumer has expressly agreed to a different method of return, which does not involve any costs for him.

§8.

Return and complaint policy

  1. If the purchased product is inconsistent with the contract or has physical defects, the Customer has the right to file a complaint based on:
    a) regulations provided for in the provisions of the Act of 27 July 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended), if the product is inconsistent with the contract,
    b) regulations provided for in the provisions of the Civil Code in the field of warranty for defects.

  2. In order to submit a complaint, the customer is obliged to inform the store by e-mail to sklep @ sleekandhandy. com, and then proceed in accordance with the information received.

  3. When specifying requests based on the procedure provided for in Art. 1 section a) The customer has the right to request that the product be brought into conformity with the contract by free repair or replacement, unless the repair or replacement is impossible or requires excessive costs. If the Store is not able to meet certain requests, the Customer has the right to demand the applicable price reduction or may withdraw the contract.

  4. When specifying requests based on the procedure provided for in Art. 1 paragraph b) The customer has the right to withdraw from the contract or demand a price reduction. The customer may not withdraw from the contract if the Store immediately, at the latest within 14 days, replaces the defective item with an item free of defects or removes the defects immediately. This limitation does not apply if the item has already been replaced by the Store or repaired, unless the defects are irrelevant.

  5. The Store is responsible for the non-compliance of the consumer product with the contract (Article 1 (a)) only in cases and under the conditions provided for by law.

  6. The Store is responsible for product defects on the basis of the warranty (Article 1 (b)), in cases and under the conditions specified by law.

  7. The Store considers complaints within 14 days from the date of receipt of the complaint by the Store along with the complete, complained product.

  8. The store reserves the right to refuse to accept the complaint in the event of any modification of the product by the customer.

  9. The store reserves the right to refuse to accept a complaint in cases of: the sole fault of the user, mechanical damage, improper maintenance and use of the product inconsistent with the User Manual.

  10. If the complaint is accepted, the shipping costs of the advertised product will be reimbursed to the Customer within 14 days from the date of acceptance of the complaint.

§9.

Privacy Policy

Acting in accordance with Art. 13 sec. 1 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (Journal of Laws of the EU .L.2016.119.1), hereinafter referred to as: "GDPR", we would like to inform you that:

  1. The condition for finalizing purchases in the Store is to provide all the Customer's data required by the content of the form and to select the appropriate checkbox constituting the Customer's consent to the processing of his personal data by the Seller and the checkbox for confirmation of reading and accepting these Terms & Conditions.

  2. All Customer data provided during registration in the Store will be used only for the purpose of implementing, changing or terminating the Sale Contract or other marketing activities, in particular informing about new products and services of the Store, provided that the Customer agrees by checking the appropriate checkbox for sending commercial information by means of electronic communication within the meaning of the new Regulation of the European Parliament and of the Council (EU) 2016/679 of 27/04/2016.

  3. All personal data of the Customer will be processed by the Seller in accordance with the content of the act referred to above.

  4. The administrator of the Customer's personal data is the Seller (see §1 Art. 2).

  5. Only personal data provided by the customer voluntarily is collected. The data is processed for the purpose necessary to implement the provisions of these Regulations, and in particular to conclude a contract for the sale of the ordered goods, deliver the goods to the customer for which the customer placed the order, issue a document confirming the sale of goods, store personal data in the IT accounting system to ensure the history of commercial transactions made through the Store.

  6. The data provided when placing the order are also processed by the following entities in the given scope: name and surname, address, telephone number, e-mail address indicated as the delivery address are provided to shipping companies in the form of a label / consignment note which is also an order for delivery. Depending on the selected type of shipment, the data is transferred to:
    a) Poczta Polska S.A. (Polish postal service),
    b) InPost S.A.
    c) another shipping company indicated by the customer.

  7. The data is also processed by entities related to the implementation of payment for the order:
    a) mBank S.A.
    b) Blue Media S.A.
    In such cases, the amount of data transferred is limited to the required minimum. In addition, the information you provide may be made available to competent public authorities, if required by applicable law.

  8. The data administrator is not responsible for providing false or incomplete personal data by the customer.

  9. The customer at any time has the right, via the Store's customer service, to change, correct or delete his/her personal data.

  10. With additional consent given by the Customer, the collected personal data may also be used for promotional and marketing purposes, including in particular to present the Customer the store's commercial offer and other marketing information related to the Store.

  11. The store uses, inter alia, the so-called "cookies", which contribute to greater usability, functionality and ease of use of our store. These instruments also make it easier for customers to navigate faster around the Store. In addition, cookies allow you to measure the frequency of page views and the most viewed products. Cookies are small text files that are stored on your computer system. Please be advised that some of these files are transferred from the Store's server to the Customer's computer system. It is possible to block cookies at any time, as long as the browser used has an appropriate function. It should be remembered that after blocking cookies, the possibility of using some of the Store's functions will be significantly limited or disabled.

§10.

Final Provisions

  1. All content contained in the Store is subject to legal protection and all rights to them belong to the Seller. Any use of them without the consent of the Seller will be a violation of the law.

  2. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code, and in the case of Customers who are Consumers, also the provisions of the Act of 30 May 2014 on consumer rights. Legal disputes will be settled by the court competent for the address of the Seller's registered office.
